PROCESS:
The process of adopting child from India is
more bureaucratic than many other
international programs because India is a
Hague country and adoption is not finalized
in country of origin. Indian court procedure
appoints adopting parent(s) guardian(s) of
child. The actual adoption is completed in
local county court where the family resides.
|
|
AIAA is both Hague and CARA (Indian Central
Authority) accredited.
To begin the
process, see “Getting
Started with AIAA” on the web site.
If you live in
Michigan, AIAA will complete home study and
post placement supervision. Out-of-State
applicants, see Attachment to Getting
Started, Choosing an Out of State Local
Social Service Provider. An official child
referral cannot be made until the
prospective adoptive applicant(s) filed
I-800A application (which includes a Hague
appropriate home study) and has been
approved by the US National Benefit Center
(NBC).
After the acceptance of the child referral,
processing begins with filing of an I-800,
approvals by both US Citizenship and
Immigration Service (CIS) and CARA for both
the prospective adoptive applicant(s) and
the child. Following approval, case is filed
in local court where the child resides. Once
guardianship order is granted, process
continues in India to obtain Indian passport
for child. Family travels to India and
completes visa process at US Embassy in
New Delhi. Estimated stay in India is a minimum
of 10 days including travel.
At least one parent travels to India to
escort their child home.
Children receive automatic US citizenship
following the finalization of the adoption
in the county the prospective adoptive
parents reside. However, parents should
apply for Certificate of Citizenship.
